T&S Wins Jury Trial in Consumer Dispute

On July 13, 2021, Thompson & Skrabanek, PLLC partner J.R. Skrabanek prevailed on behalf of his consumer client in a virtual jury trial in Travis County District Court. The trial concerned a dispute brought under Texas's Deceptive Trade Practices Act against the gas station chain Circle K and its fuel delivery company, American Energy Transport. The Firm's client's vehicle was irreparably damaged through no fault of her own when the defendants negligently placed and stored the incorrect fuel in Circle K's underground storage tanks. The Firm's client unwittingly filled up her gas tank with the improper fuel.


The jury issued a unanimous verdict in favor of the Plaintiff (and T&S client), awarding her substantial damages in addition to her attorney's fees.


Because of the COVID-19 pandemic, the case was tried virtually before the Honorable Catherine A. Mauzy of the 419th District Court. The trial was one of the first dozen cases to be tried virtually in Travis County, Texas.
