T&S is pleased to share that on July 27, 2023, J.R. Skrabanek prevailed in a construction defect trial that was held in New York County Supreme Court.
The case was filed by a homeowner against T&S's client, an installer of high end wood flooring. The consumer alleged that the flooring contractor performed a defective installation in his apartment located in the Upper East Side, which the contractor disputed. The consumer sought $102,000 in damages for the cost to completely tear out and replace the contractor's flooring in the whole apartment.
The case was tried to the bench in Manhattan before Justice Nicholas W. Moyne between July 24 and July 27, 2023. Expert and fact witness testimony was presented by both sides. At the trial's conclusion, Justice Moyne awarded the plaintiff just $6,500 in total damages for very minor issues with the flooring that the installer and all the experts had already conceded was the installer's fault.
All other relief was denied by the Court, and the client is very pleased with the outcome.
